The scope of the permit required confined space standard is specific in limiting the application of the standard to permit required confined spaces as defined in the definitions section of the standard. The definition of a permit required confined space includes four criteria, any one of which would define the space as one requiring a permit. The first two criteria listed include the "potential" for the condition to exist (hazardous atmosphere and engulfment).

If the operation to take place in the confined space has the potential to create a hazardous atmosphere or an engulfment hazard, then the confined space would require a permit for entry. If that potential does not exist and neither of the two remaining criteria are met then the space is not a permit required confined space and the standard does not apply.

Other OSHA standards may apply to the operation and should be followed.
