29 CFR 1910.146(k) addresses emergency rescue service employees and it does not require a permit for entry into a permit- required confined space for emergency rescue. Fire brigades are covered under 1910.156, which prescribes ppe for firefighters, including a requirement for pressure demand air supplied respiratory protection for entry into confined spaces where there may be an atmospheric hazard. Appendix A to Subpart L, 29 CFR 1910.156 delineates personal protective equipment criteria and other requirements governing fire department/brigade operations. Standard operating procedures and fire department pre-plans should address the appropriate response in confined spaces.
